Terms and Conditions of using and advertising on tv-bay.com

Tv-bay.com is an advertisement only site. All ads are taken on the condition that the purchaser will contact the seller directly and tv-bay.com will have no involvement in any sale whatsoever. Tv-bay.com are not responsible for any advert being correct or factual and it is the responsibility of the purchaser to ensure that prior to purchase they are satisfied the item is in the order they are expecting. All financial transactions involved with the purchase will be performed exclusively between the seller and purchaser, tv-bay.com will take no commission or have any interest in the sale price.

No adverts will be accepted that contain language or pictures unsuitable for a public site or likely to cause offense to viewers.

Tv-bay may provide a data entry facility whereby tv-bay staff enter lists of products for sale on the advertisers behalf. At no time does tv-bay accept any responsibility whatsoever for the accuracy of this data entry and it remains the advertisers responsibility to check these adverts for accuracy and ammend if necessary. Naturally tv-bay staff will take ever care to ensure errors are minimal.

Tv-bay.com reserves the right to change, amend or remove any advert at any time which in its sole discretion is deemed unsuitable for this site. If adverts are changed or removed you will be notified by email.

At certain times tv-bay may offer free of charge banners for limited durations. tv-bay reserves the right to remove these banners at anytime without notice to the advertiser. tv-bay will take all precautions possible to ensure that any banner shown on the site remains on the site for the duration paid for, however in the event of a server problem or other problem outside the control of tv-bay we will not accept responsibility for any loss whether direct or indirectly related whatsoever.

Banner Terms and Conditions (these only apply to banner adverts and do not apply to adverts placed on the site for equipment for sale, wanted, hire or jobs)
Delivery Policy : tv-bay will accept artwork for chargeable banner adverts and if acceptable will provide the advertising facility within 7 working days or at a time agreed in writing between tv-bay and the customer
Refund Policy : When an order is recieved and actioned as required by tv-bay then there will be no refund to the customer.
Replacement Policy : If the customer is not satisfied with the banner artwork then tv-bay will replace with a different image if within 2 days of the banner advert appearing on the site the customer notifies tv-bay of this desire. This is in addition to the customer changing artwork via customer log in area.
Cancellation Policy : When tv-bay receives a purchase order then it can not be cancelled
Currency : tv-bay accept Sterling, Euro or Dollar via our on-line store
Export : There are no restrictions on export location

General Advertising - CREDITS.
Persons or companies wishing to place an advertisement on tv-bay (who do not have other arrangements with tv-bay) may purchase credits and exchange these for a variety of adverts. Credits will remain on the users account for 12 months after purchase and can be exchanged for adverts by the user. tv-bay are continually adding new features to the site and as such may add further enhancements to the adverts, in this case current adverts can not be exchanged for new style ones unless the program structure requires this to happen.
Once an advert is added it is not possible to change or edit a number of main fields. All adverts are shown in a preview screen prior to going live and it is the advertisers responsibility to ensure all information is correct. Some editing is possible and can be done by the advertiser via the user profile log-in.
tv-bay reserve the right to remove any advert that in its sole discretion deems unsuitable for the site - in this case the credits will be refunded to the advertisers account.
All payments are handled by secpay.com and all amounts include VAT at the current rate.
There are no refunds available for adverts and credits can be purchased in Sterling, Dollars or Euros.

Terms and Conditions of ordering from the tv-bay on-line store.
Tv-bay and it’s partner suppliers and manufacturers want you to be totally satisfied with your purchase from our store, please call us on +44 (0) 1635 237237 to talk to one of our dedicated engineers if you are uncertain as to the compatibility of any product with your existing or proposed equipment.

Most items are in stock either at our premises or directly at our suppliers.  However, if you place an order and the goods are not in stock or not available within 5 working days then we will contact you to confirm the lead time for the item/s concerned to confirm that you wish to proceed with the order. In the event that you do not wish to proceed due to exceeding the time to ship then we will offer a full refund.

All items are shipped by courier such as DHL or UPS and usually goods will be delivered by "Next Day" delivery. However, on the occasion that your order is not in stock the term "Next Day" means that the goods will be delivered on the next business day after dispatch from our premises or that of our suppliers.

Our on-line store has been created to ensure you only pay delivery charges for exactly what you have purchased, the best way we have found to offer this is to wiegh the cart when you check out and cross reference this against our courier shipping prices – therefore you only pay for what you order. On very rare occasions this charge may not represent the true cost – for example a big box of feathers will be charged on the size of the box rather than the weight! – therefore tv-bay reserves the right to contact you after your order has been placed to advise of additional delivery charges. If you do not accept these charges then you are fully entitled to cancel your order or alternatively arrange for collection yourself.

VAT – our store is intellegient to know who should be paying tax on purchases and who should not. UK purchasers will be charged VAT at the current UK rate regardless of whether you provide your VAT number to us or not. If you are an EC member state then if you provide your TAX ID (VAT, TVA, IVA, FPA, UST, MWST, MOMS, UST) in your tv-bay registration form then you will not be charged VAT, if however you do not provide your TAX ID then tv-bay will add the UK tax rate to your invoice. The format of your TAX ID should be in-line with the form that you may download from here.

Returns Policy

In the unlikely event of a fault or other reason that means you need or wish to return the goods to us then the following conditions should be adhered to.

You must obtain our advanced authorisation before returning the goods, (in the event of a suspected fault this can often be cured by diagnosis via the phone with our engineers for example). This authorisation must be obtained by contacting us by telephone or e-mail and we will not accept packages returned without a valid returns number; this is subject to the following conditions:

• You have changed your mind and wish to cancel the order and return the goods in their original unopened and undamaged packaging within 7 days of the date of delivery to you.
  In this case, a handling charge / re-stocking fee of 20% will be applicable. 
  Shipping charges are not refundable.  Both the 20% and our original shipping charges will be deducted from your total refund.
  The responsibility for returning the goods to us is yours and any refund will not be given until the goods have been checked by us on receipt. Please ensure you have adequate insurance for shipping goods back to us.
• If you believe your goods to be faulty then you must contact our engineering department for telephone evaluation. If after this preliminary diagnosis you wish to return them complete, undamaged and with their original packaging for a full refund this must be done within 7 days of the date of delivery to you. The responsibility of returning the goods to us is yours.  Please ensure you have adequate insurance for shipping goods back to us.
  A refund will not be given until the goods are confirmed to be faulty by a tv-bay engineer or manufacturer service department.  If they are found to be faulty and have not been tampered with or any seals broken then we will offer a full refund. This process can take up to 14 days.
• You believe your goods to be faulty and wish to return them for repair/replacement under the manufacturers warranty. 
  The responsibility for returning the goods is yours. Please ensure you have adequate insurance for shipping goods back to us.
  Once the goods have been received, a tv-bay engineer will confirm the fault and where the goods are confirmed to be faulty, a repaired or replacement product ( in accordance with the manufacturers warranty conditions ) will be sent to you by our normal courier method.
  We reserve the right to charge for the shipping charges incurred during the return of the goods to the customer.
  If the goods are not found to be faulty, all return delivery charges will be the responsibility of the customer.

In all cases where goods need to be returned to us, they must be unregistered and packed complete with all accessories, software and manuals in the original manufacturers packaging and then packed in an additional outer box or covering to ensure that the product and its original packaging are returned without damage.

Please note that tv-bay will accept no liability for loss or damage that may occur to goods being shipped to us and therefore we recommend that customers undertake additional insurance with their chosen carrier as a precautionary measure. 

Collection for return of goods can be arranged but this cost will be borne by the customer.

Your right to privacy is very important. We recognize that when you choose to provide us with information about yourself, you trust us to act in a responsible manner. We believe this information should only be used to help us provide you with better service. That's why we have put a policy in place to protect your personal information. Below is a summary of our policy.

What personal information do we collect?
Some examples of information tv-bay will collect are name, address and phone number. If you sign up for a tv-bay electronic newsletter or e-mail list, each message will include instructions on how to "unsubscribe" from that list. We give you the opportunity to elect not to receive materials from us.

We will take appropriate steps to protect your privacy. Whenever you provide information we will take reasonable steps to protect it. When you provide payment information in our on-line store then this information in entered into a securely encrypted window provided by secpay.com. We will take reasonable security measures to protect your personal information in storage and they will not be sold solely for marketing purposes to third parties.

We will not provide any of your personal information to other companies or individuals without your permission. However, we may need to provide your name and delivery address to third parties that tv-bay uses for the purposes of delivering specific services to you (e.g. deliveries direct from tv-bay suppliers.)

Tv-bay provides many link to third party sites. Since we do not control those websites, we encourage you to review the privacy policies of these third party sites.

Data storage in the UK
Any information that tv-bay needs to store and process will be carried out on databases located in the UK.

How can you update the personal information you have provided to us?
You can help tv-bay maintain the accuracy of your information by updating your profile at any appropriate time. Just log on in the usual way and select PROFILE. If at any time you wish to stop receiving an electronic newsletter from tv-bay you can unsubscribe as explained in the email or editing your profile accordingly.

User Reviews
The purpose of the review is to give readers of both the website and the magazine (the complete equipment index) an insight into a users experiences of an item of broadcast or pro video equipment. Upon submitting a review, tv-bay reserve the right to edit and/or remove content which in the sole discretion of tv-bay is deemed to not be required for the review. The review may appear on the tv-bay.com website and also in the tv-bay magazine in either full or part. The images sent with the review may also be used by tv-bay or replaced with other images if more suitable images can be found. The person submitting the content remains responsible for ensuring all copyright remains with them or can be used by them and this permission is passed to tv-bay for the use of the review. By acccepting these condtions the author also agrees that tv-bay may use his or her name, company and location. tv-bay agrees to positively promote the author and his or her company with relevant contact information and images if appropriate.

Competitions
tv-bay may occasionally promote items to be won in a variety of compeitions either online, in print or a combination of both. Entry to these compeitions is at the sole discretion of tv-bay and are normally only open to tv-bay registered users and magazine subscribers. Each compeition will normally have a closing date, this date may be vary in some circumstances, the date will not be back dated so if you enter the competition whilst it is current then your entry will be counted. Winners are picked at randon my tv-bay and these results are final with no further correspondance being entered into. Winners will normally be published in the following issue of the tv-bay magazine. Prizes will either be sent from tv-bay or direct from the sponsoring company within 28 days of the closing date. For larger prizes you may occasionally be asked to collect or arrange collection.

Subscriptions
tv-bay offers a chargeable subscription for some services including the printed magazine. All subscriptions are for a minimum twelve month period where direct debit payment (or other form of payment) is made. Where a free gift is offered as part of the subscription offer then tv-bay reserve the right to charge the full cost of the free gift as well as set-up administration charges in the unlikely event that the payment instruction is cancelled within twelve months.
